Terms and Conditions

This agreement (the "Agreement") is made between you (the "Client") and Evie Garnett (the "Designer"). By accepting this quote or confirming work, both parties agree to the following terms and conditions.

1. Scope of Work

The Designer agrees to produce creative materials (e.g. branding, graphics, illustrations) as requested by the Client for an agreed fee and timeline. All work will be original, created solely by the Designer, and free from plagiarism. The Client is encouraged to provide feedback throughout the design process before final sign-off.

2. Confidentiality & Data Protection

Any confidential or sensitive information shared by the Client will be stored securely and not shared with third parties unless legally required. All client data will be handled in accordance with GDPR. Clients may request a copy of the data held or ask for it to be deleted at any time.

3. Fees & Payment

Project fees will be agreed in writing before work begins. If the scope changes, the Designer will provide a revised quote. Payment is due within 30 days of invoice. If the Client fails to respond with feedback or sign-off within 60 days, the Designer may consider the project complete and issue the final invoice.

4. Liability & Client Responsibility

The Client is responsible for final proofreading, checking specifications, and approval before printing or publication. The Designer accepts no responsibility for errors after final approval.

5. Cancellation

Either party may terminate this agreement in writing. The Client agrees to pay for all work completed up to the date of cancellation. If the project is cancelled after completion, the full fee remains payable. In all cases, the Designer retains ownership of all draft and completed work until full payment is made.

6. Copyright & Portfolio Use

The Designer retains full copyright and ownership of all materials until final payment is received. Upon full payment, usage rights may be transferred as agreed in writing. Unless the Client requests strict confidentiality in advance, the Designer reserves the right to display completed work in her portfolio and marketing channels.

7. Disclaimer

Design services are creative and advisory in nature and do not constitute legal, strategic, or financial advice. Clients are responsible for seeking appropriate professional input where needed.

8. Governing Law & Jurisdiction

This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it shall be governed by and construed in accordance with the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

9. Acceptance

By accepting this quote or confirming work, both parties acknowledge and agree to the terms of this Agreement.
